These Terms of Service ("Terms") govern your access to and use of the services provided by ServerDataHost ("we," "us," or "our"), including cloud hosting, VPS, dedicated servers, and related services (collectively, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms.

1. Account Registration

• You must provide accurate, complete, and current information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials, including passwords and SSH keys.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years of age to use our Services.
• One person or entity may not maintain more than one free-tier account.

2. Services and Availability

• We will make commercially reasonable efforts to maintain 99.99% uptime for our infrastructure.
• Scheduled maintenance will be communicated at least 48 hours in advance when possible.
• We reserve the right to modify, suspend, or discontinue any aspect of the Services with reasonable notice.
• Service Level Agreements (SLAs) for specific plans are detailed on our pricing page and form part of these Terms.

3. Acceptable Use

You agree not to use our Services to:

• Violate any applicable local, state, national, or international law or regulation
• Distribute malware, viruses, or other harmful software
• Send unsolicited bulk email (spam) or operate open mail relays
• Host content that infringes on intellectual property rights of others
• Conduct phishing, fraud, or deceptive practices
• Launch denial-of-service attacks or port scanning against other systems
• Mine cryptocurrency without prior written approval
• Host content depicting child exploitation or abuse
• Engage in any activity that disrupts or interferes with our infrastructure or other customers' services
• Circumvent or attempt to circumvent resource limits, quotas, or security controls

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy without prior notice.

4. Payment and Billing

• Services are billed in advance on a monthly or annual basis as selected during sign-up.
• All fees are non-refundable except as expressly stated in our refund policy or required by law.
• We offer a 30-day money-back guarantee for new accounts on monthly plans.
• Failed payments will result in a 7-day grace period, after which services may be suspended.
• Accounts suspended for non-payment will have data retained for 14 days before permanent deletion.
• We reserve the right to change pricing with 30 days advance notice. Price changes do not apply to existing billing periods.
• All prices are listed in USD unless otherwise stated. Applicable taxes will be added at checkout.

5. Data and Content

• You retain full ownership of all data and content you store on our servers ("Your Content").
• You grant us a limited license to store, process, and transmit Your Content solely for the purpose of providing the Services.
• You are solely responsible for maintaining backups of Your Content. While we offer backup services, they are provided as a convenience and do not replace your responsibility to maintain independent backups.
• We do not access, review, or monitor Your Content except as required for service operation, at your request for support purposes, or as required by law.

6. Server Management and Root Access

• For unmanaged VPS and dedicated servers, you have full root access and are responsible for server administration, security, and software maintenance.
• We are not liable for security breaches, data loss, or service disruptions caused by your server configuration or installed software.
• We may take emergency action on your server (including suspension) if it poses a threat to our infrastructure or other customers.

7. Resource Usage

• Each plan includes specific resource allocations (CPU, RAM, storage, bandwidth).
• Exceeding allocated resources may result in throttling, overage charges, or service suspension depending on your plan.
• "Unlimited bandwidth" plans are subject to a fair use policy. We reserve the right to throttle connections that negatively impact network performance.

8. Intellectual Property

Our website, branding, software, APIs, and documentation are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our proprietary technology without written permission.

9. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claim arising from the Services shall not exceed the fees paid by you in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
• We are not liable for damages resulting from circumstances beyond our reasonable control, including natural disasters, power outages, network failures, or actions of third parties.

10. Indemnification

You agree to indemnify and hold harmless ServerDataHost, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another party.

11. Termination

• You may cancel your account at any time through your account dashboard or by contacting support.
• We may terminate or suspend your account for violation of these Terms, non-payment, or at our discretion with 30 days notice.
• Upon termination, your data will be retained for 14 days to allow for retrieval, after which it will be permanently deleted.
• Sections regarding liability, indemnification, and dispute resolution survive termination.

12. Dispute Resolution

Any disputes arising from these Terms or the Services will first be attempted to be resolved through good-faith negotiation. If unresolved after 30 days, disputes will be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 30 days before the changes take effect. Continued use of the Services after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
